If you have received notice that a Bench Warrant has been issued against you, you MUST contact an attorney immediately to take care of this issue. Typically, a Bench Warrant is issued if you missed a Court appearance for anything (even a simple parking ticket). Once issued, the Judge is ordering that the Police arrest you, and hold you in County Jail until bail is set and Court date is issued.
Once issued, you never know when the police will come, and whether it will be at your home, place of work, or even just when you might be stopped for a minor traffic offense. In addition to being subject to arrest, you will also have your NJ license immediately suspended by the DMV, and should you drive and get stopped, you will also be facing severe penalties for driving on the revoked list.
Often I get calls from frightened clients who receive notices of Bench Warrants saying they have no idea what happened, they did not realize they missed a Court date, and are frantically asking what they can do?
Should you find yourself in this situation, give me a call at (973) 686-9787. We will immediately contact the Court Administrator and make arrangements to have the Warrant lifted and a new Court date set. This will remove the risk of you being arrested and held in the County Jail. Depending on the circumstances this might require bail being posted, but often even this can be avoided. The trick is to take action immediately, so your mistake can be corrected, and you are placed back on the proper track to handle your open matter. Even if you have waited to handle the Bench Warrant, things can be done if we approach the Court first, rather then the Court having needed the Police come and get you.
Things in life happen, and often it comes down to not what you did, but how you handle it. I have seen small matters like an unpaid parking ticket escalate into a situation with extremely serious consequences because it was not taken care of in a timely fashion, while other matters involving very serious charges are dismissed outright because of they way they were handled.
