New Jersey has always had a clear-cut rule. If you are stopped with no Insurance on the car you are driving, and your convicted, you will lose your license for 12 months. Your suspension could not be any longer, nor could it be any less than 1 year. In these matters the Judge’s hands were tied. However, in early 2014 the laws in the State of New Jersey changed. Now, for the first time a Judge may take your license for less than 12 months, or even not take it at all for a conviction of driving with no insurance. Discretion lies with the Judge based on the facts and reasoning and conduct you took that he/she hears during your sentencing.
