Effective July 1st 2014, penalties for using a cell phone while driving in NJ will increase pursuant to N.J.S.A. 39:4-97.3. For a first offense the fine will now increase to $200-$400. A second offense will carry a fine of $400-$600. For a third or subsequent offense the penalty will now be $600-$800, a possible loss of license of up to 90 days, plus you will be assessed 3 points against your license by the DMV. Under the new law, any past convictions will count against future charges. This means if you have 2 past convictions for using a cell phone, and you are charged for a violation after July 1st, you will now face the penalties as a third time offender. (Including possible loss of license and points) The exception to this is if there is a 10-year gap between offenses. If this occurs, you might be eligible to a step down to a lower penalty.
