An Expungement will seal any previous arrest, charges and convictions. Once granted by a Judge, you will legally be able to answer “NO” to the following questions:

  • Have you ever been arrested?
  • Have you ever been charged with any crime?
  • Have you ever been convicted of any crime?

Changes in New Jersey Law allows more people to qualify for an expungement

There have been some recent changes in New Jersey Expungement law that has reduced the period of time you must wait, and has also increased the number of past charges that can be removed from your record.  Even if in the past you were told you are not eligible to have something removed from your record, the laws may have changed to help your situation.

You can now expunge one indictable (felony) conviction and up to three disorderly or petty disorderly persons offenses as long as it has been at least 5 years (possible 4 years in some cases) since you finished your sentence for the most recent offense.

Under the new “Clean State Expungement” provision, multiple indicatable (felony) convictions can now be removed for the first time. This means that if it has been at least 10 years since your last offense you could be eligible to have your entire past criminal record expunged.

Under the new “Marijuana Expungement” statute,  expungements for most past convictions and arrests for marijuana offenses can now be filed immediately.

Crimes not eligible

Not every type of charge can be removed from your record. Things that typically cannot be expunged include murder, manslaughter, treason, kidnapping, rape, arson, perjury, aggravated criminal sexual contact and certain drug distribution matters.
